      <content:encoded><![CDATA[<p>People were being scammed long before email and malware entered into daily use &#8212; and it&#8217;s still happening offline as well as online. So what to do if you know that someone you love is being victimized and scammed?</p>
<p>That&#8217;s the question the Consumerist asked readers today, with a story about a <a rel="nofollow" target="_blank" href="http://consumerist.com/5083442/she+grifters-scam-granddad-for-10000%252B-a-month">Florida grand-dad </a>whose gardener is supposedly fleecing him for over $10k / month, allegedly to help an ailing friend:</p>
<blockquote><p>Shaun says his 80+-year old grandfather, Steve, is being scammed out of over $10,000 a month. It seems Steve recently hired a female gardener who introduced him to a &#8220;wealthy friend,&#8221; and now he&#8217;s loaning them money to pay for groceries, cable, home upkeep, and, get this, bodyguards to protect her from an ex-husband and son who to want to kill her. When the family tries to intervene, Steve says the family is trying to put him in a nursing home and steal his money. Shaun is at a loss. How can he help his grandfather, who doesn&#8217;t want to be helped?</p></blockquote>
<p>Another question that might be relevant in the IT Security community is, are the elderly more prone to these scams, and if so why? In the tech world it&#8217;s widely assumed that the older generation just has a harder time learning and grasping how to use technology so may not understand what is risky and what isn&#8217;t.</p>
<p>But perhaps there&#8217;s a deeper problem, either with some form of dementia and paranoia in the older years, or just a purer vulnerability associated with being alienated from the new, cutting edge and modern world as we age, or some kind of unwillingness to be suspicious because of the need to have caring people around you?</p>]]></content:encoded>

      <content:encoded><![CDATA[<p>Gartner&#39;s own John Pescatore has issued a 12 world <a href="http://blogs.gartner.com/john_pescatore/2008/10/28/twelve-word-tuesday-measuring-security-program-effectiveness/">post:</a></p><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><p><span style="color: #333333; font-family: Arial; font-size: 14px; line-height: 17px; ">The best security program is at the business with the happiest customers.</span></p></blockquote><br /><div>Happiness? Really? That&#39;s the measure of program effectiveness? I would see those 12 words and raise them one word (13 if you&#39;re scoring at home):</div><br /><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><p>There&#39;s a fine line between happy customers and playing piano in a bordello.</p></blockquote><br /><div>I mean the people running hedge funds and derivative books at AIG, Lehman and friends had lots of happy customers for the last decade!</div><br /><div>To me the happy customer is a classic IT copout &quot;we just did what the &quot;business&quot; asked&quot;. Like we&#39;re just a bystander or something. Its our job to create business value and be business like. We should seek to <span style="font-style: italic;">empower</span> out customers, not make them happy.&#0160;</div><br /><div>Please understand I am not that guy who says IT security has to be the &quot;bad cops&quot; who deny everything the business wants to do. Just saying it is our job to raise the bar where we can. Raising the bar does not always create super happy customers in the short run, but it does empower companies.</div><br /><div>Unfortunately, playing piano in the bordello is what a lot of security groups do and even big analyst firms. The path of least resistance ain&#39;t always the way. Here is an example. I was at a client many years ago, they wanted to build a big Identity Management solution, so of course they wrote a big RFI got responses from Sun, IBM, Oracle and friends. The bids were in the $3-5 million range. Pretty big projects for an Infosec team. So what do you do? Call up a big analyst firm and get some advice, right?</div><br /><div>A week goes by and we get an audience with the &quot;guru&quot; from the Big Analyst Firm. The client has pretty detailed requirements, what systems they want to connect to, what use cases they are looking to solve for, &#0160;and so on. We anxiously await the knowledge the analyst is about to transfer to us. His response was as follows - &quot;what kind of shop are you? IBM shop? Oracle shop?&quot; &quot;Ummm...we are a huge company we have everything.&quot; &quot;Well if you are more of a IBM shop you should go with them. If you are more of a Oracle shop you should go with them.&quot; That was the extent of a 30 minute conversation. True story.</div><br /><div>Of course, the one value proposition of the Big Analyst Firms is that they supposedly can tell you what everyone else is supposedly doing. There is some value in this I grant you. And it does make for happy customers because even when you force your customers to change, you can say &quot;Well geez, I know its hard but the Big Analyst Firm says that everyone is doing it.&quot; But is this security improvement?</div><br /><div>Back in 2004, I went to a great security conference, it was Information Security Decisions (<a href="http://infosecurityconference.techtarget.com/conference/index.html">they are back in Chicago next week</a>). It was in Chicago, downtown on the river. Tom Davern even took us all out on a boat for lunch one day. Anyway, there was one truly great talk there. It wasn&#39;t Fred Cohen debating <a href="http://cigital.com/justiceleague/">Gary McGraw</a> on application security which was outstanding (in which Fred uttered the memorable line &quot;I agree with Gary everywhere he agrees with me.&quot; (Gary won the debate, his best line - &quot;We know how to win the software security war, but we don&#39;t know how to manage the peace&quot; still the problem today actually)) It wasn&#39;t Pete Lindstrom showing his security metrics framework (which is still a great starting point). it wasn&#39;t Dan Geer&#39;s fireside chat.</div><br /><div>The truly great talk, though, was by the now departed <a href="http://1raindrop.typepad.com/1_raindrop/2007/02/thinking_about_.html">Robert Garigue</a>. It was called &quot;Its the End of the CISO as I Know It, (And I Feel Fine).&quot; The whole end to end talk was wonderful, there are several things in there that I still use every single day like the separate security models for Infostructure and Infrastructure but the point I want to talk about is the CISO role.</div><br /><div>Garigue talked about the two most prevalent CISO models - the jester and the bad cop. The jester CISO</div><br /><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><p><span style="color: #333333; line-height: 19px; ">Sees a lot</span><br /><span style="color: #333333; line-height: 19px; ">Can tell the king he has no clothes</span><br /><span style="color: #333333; line-height: 19px; ">Can tell the king he really is ugly</span><br /><span style="color: #333333; line-height: 19px; ">Does not get killed by the king</span><br /><span style="color: #333333; line-height: 19px; ">Nice to have around but…how much security improvement comes from this ?</span></p></blockquote><p><span style="color: #333333; line-height: 19px;"><br /></span></p><div><span style="color: #333333; line-height: 19px;">The jester has happy customers! Charlemagne never stopped studying. He brought an English monk, Alcuin, and other scholars to his court - encouraging the development of a standard script.</p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; ">He set up money standards to encourage commerce, tried to build a Rhine-Danube canal, and urged better farming methods. He especially worked to spread education and Christianity in every class of people.</p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; ">He relied on Counts, Margraves and Missi Domini to help him.</p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; ">Margraves - Guard the frontier districts of the empire. Find software security champions in the architecture and development groups,help them understand the real security issues. They will find solutions you have not thought of. Same for DBAs, same for business analysts even. Its all about beating the bushes, education, and decentralizing security services. Specifically, he points out this important mandate for IT security</p><p></p><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><p><span style="color: #333333; line-height: 19px; ">Knowledge of risky things is of strategic value</span></p></blockquote><blockquote class="webkit-indent-blockquote" style="margin: 0 0 0 40px; border: none; padding: 0px;"><p><span style="color: #333333; line-height: 19px; ">How to know today tomorrow’s unknown ?</span><br /><span style="color: #333333; line-height: 19px; ">How to structure information security processes in an organization so as to identify and address the NEXT categories of risks ?</span></p></blockquote><p><span style="color: #333333; line-height: 19px;"></span></p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; ">To me this is our mandate and measure of effectiveness. Empower our customers, educate, and create business value. If I am a CISO &#0160;I don&#39;t want 20 people reporting to me who do firewall ruleset changes. I want one champion in 20 different groups - development teams, architects, DBAs, business analysts.</p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; ">A concrete example, infosec can continue to go along with the herd and follow the &quot;what everyone else is doing architecture&quot; meanwhile developers are connecting <span style="font-style: italic;"><span style="font-weight: bold;">every single thing</span></span> in your business to the Web. I have been doing integration and new technology projects for a long time, and let me tell you - Change does not always create happy customers in the short run. But the chart below shows that information security is maybe more concerned with not causing waves rather than adapting.</p><p style="margin-top: 10px; margin-bottom: 10px; text-align: left; "></p>

      <title><![CDATA[Kip Hawley Responds to My Airport Security Antics]]></title>

      <content:encoded><![CDATA[<p>Kip Hawley, head of the TSA, has <a href="http://www.tsa.gov/blog/2008/10/tsas-take-on-atlantic-article.html">responded</a> to my <a href="http://www.schneier.com/blog/archives/2008/10/me_helping_evad.html">airport security penetration testing</a>, published in <i>The Atlantic</i>.</p>

<p>Unfortunately, there's not really anything to his response.  It's obvious he doesn't want to admit that they've been checking ID's all this time to no purpose whatsoever, so he just emits vague generalities like a frightened squid filling the water with ink.  Yes, some of the stunts in article are silly (who cares if people fly with Hezbollah T-shirts?) so that gives him an opportunity to minimize the real issues.</p>

<blockquote>Watch-lists and identity checks are important and effective security measures. We identify dozens of terrorist-related individuals a week and stop No-Flys regularly with our watch-list process.</blockquote>

<p>It is simply impossible that the TSA catches dozens of terrorists every week. If it were true, the administration would be trumpeting this all over the press -- it would be an amazing success story in their war on terrorism.  But note that Hawley doesn't exactly say that; he calls them "terrorist-related individuals."  Which means exactly what?  People so dangerous they can't be allowed to fly for any reason, yet so innocent they can't be arrested -- even under the provisions of the Patriot Act.</p>

<p>And if Secretary Chertoff is telling the truth when he <a href="http://www.cnn.com/2008/TRAVEL/10/22/no.fly.lists/index.html">says</a> that there are only 2,500 people on the no-fly list and fewer than 16,000 people on the selectee list -- they're the ones that get extra screening -- and that most of them live outside the U.S., then it is statistically impossible that the TSA identifies "dozens" of these people every week.  The math just doesn't make sense.</p>

<p>And I also don't believe this:</p>

<blockquote>Behavior detection works and we have 2,000 trained officers at airports today. They alert us to people who may pose a threat but who may also have items that could elude other layers of physical security.</blockquote>

<p>It does work, but I don't see the TSA doing it properly.  (Fly El Al if you want to see it done properly.)  But what I think Hawley is doing is engaging in a little bit of psychological manipulation.  Like sky marshals, the real benefit of behavior detection isn't whether or not you do it but whether or not the bad guys <i>believe</i> you're doing it.  If they think you are doing behavior detection at security checkpoints, or have sky marshals on every airplane, then you don't actually have to do it.  It's the threat that's the deterrent, not the actual security system.</p>

<p>This doesn't impress me, either:</p>

<blockquote>Items carried on the person, be they a 'beer belly' or concealed objects in very private areas, are why we are buying over 100 whole body imagers in upcoming months and will deploy more over time. In the meantime, we use hand-held devices that detect hydrogen peroxide and other explosives compounds as well as targeted pat-downs that require private screening.</blockquote>

<p>Optional security measures don't work, because the bad guys will opt not to use them.  It's like those air-puff machines at some airports now.  They're probably great at detecting explosive residue off clothing, but every time I have seen the machines in operation, the passengers have the option whether to go through the lane with them or another lane.  What possible good is that?</p>

<p>The closest thing to a real response from Hawley is that the terrorists might get caught stealing credit cards.</p>

<blockquote>Using stolen credit cards and false documents as a way to get around watch-lists makes the point that forcing terrorists to use increasingly risky tactics has its own security value.</blockquote>

<p>He's right about that.  And, truth be told, that was my sloppiest answer during the original intervied.  Thinking about it afterwards, it's far more likely is that someone with a clean record and a legal credit card will buy the various plane tickets.</p>

<p>This is new:</p>

<blockquote>Boarding pass scanners and encryption are being tested in eight airports now and more will be coming.</blockquote>

<p>Ignoring for a moment that "eight airports" nonsense -- unless you do it at every airport, the bad guys will choose the airport where you don't do it to launch their attack -- this is an excellent idea.  The reason my attack works, the reason I can get through TSA checkpoints with a fake boarding pass, is that the TSA never confirms that the information on the boarding pass matches a legitimate reservation.  If all TSA checkpoints had boarding pass scanners that connected to the airlines' computers, this attack would not work.  (Interestingly enough, I noticed exactly this system at the Dublin airport earlier this month.)</p>

<blockquote>Stopping the ‘James Bond’ terrorist is truly a team effort and I whole-heartedly agree that the best way to stop those attacks is with intelligence and law enforcement working together.</blockquote>

<p>This isn't about "Stopping the 'James Bond' terrorist," it's about stopping terrorism.  And if all this focus on airports, even assuming it starts working, shifts the terrorists to other targets, we haven't gotten a whole lot of security for our money.</p>

<p>FYI:  I did a <a href="http://www.schneier.com/interview-hawley.html">long interview</a> with Kip Hawley last year. If you haven't read it, I strongly recommend you do.  I pressed him on these and many other points, and didn't get very good answers then, either.</p><div class="feedflare">

      <title><![CDATA[Given the Current Economic Turmoil, What Should IT Managers Do?]]></title>

      <content:encoded><![CDATA[Gartner's Compliance & Risk Management Research Community met recently and considered what IT managers should do given the economic turmoil spreading around the world.<br />

What started as a problem with risky mortgages in hot real estate markets in the United States has spread to Wall Street with a devastating impact on the financial health and well being of a number of banks and an insurance company. Each day, the turmoil spreads, first to the equity and commodity markets where investors and speculators attempt to preserve what capital remains. Next, the central banks and governments rush in with an infusion of liquidity in an attempt to keep the money flowing through the world's financial market.<br />
<br />
The media commentary on the current financial crisis sounds the tone that all the laws of economics and free markets no longer apply. The reporters sound as if the next developments will be Mother Nature suspending the laws of physics and gravity. Against this backdrop, CIOs and IT managers wonder, "What do we do?"<br />
<br />
There is no denying that business as usual is not currently happening. To speculate or attempt to deal with the regulatory fallout that will follow this financial crisis is currently a waste of time. The central focus that CIOs must address now is what impact will this financial crisis have on IT in the next budget cycle. Also, how can IT help the enterprise demonstrate trustworthiness to key stakeholders, maintain critical functions that drive revenue and cash flow, and focus on the needs of the people who work for your organization.<br />
<br />
At the heart of the current financial crisis is a lack in confidence in the credit markets. Government officials report that interbank lending has ground to a halt, which prompted the U.S. Federal Reserve to step in on 7 October 2008 and offer direct short term lending to U.S. corporations. <br />
<br />
First, to combat this lack of confidence permeating the market, enterprises should take extraordinary means to increase their financial transparency and demonstrate that they have the ability to meet their obligations to creditors, customers, and the communities where they are located. Senior management must develop and exercise a voice in the public policy dialog immediately - and voluntarily. Do not wait for Congressional subpoenas, shareholder meetings, or ambush interviews by the media. Tell the world, honestly, about the state of your company and its plans for the near term and the long view.<br />
<br />
Second, everyone must develop a laser-like focus on the organization's value proposition, those intangible reasons that define why your enterprise exists. To leverage an old cliché, every oar must be in the water and pulling in the same direction. The goal is not just to make it to the finish line, but to survive. Ancillary or tertiary projects must be postponed for a later time; and tasks that improve customer service, remove friction from processes, and increase cash flow should be top priorities.  <br />

Finally, think about the people who work for you. No doubt they are scared by the uncertainty about the future. Management must be honest and open in keeping the rank and file apprised of the organization's situation. They should be encouraged to communicate that information in a timely fashion with friends and neighbors in the community. Management should be extremely sensitive to non-work related issues that may have an impact on employee morale and well being. The most obvious is related to housing, mortgage default and potential foreclosure. However, it can extend beyond the most obvious issues. The problem with short-term lending is also having an impact on some governmental agencies, and some school districts are cutting back to only four days of instruction, forcing many parents to scramble and find new daycare arrangements. ]]></content:encoded>

      <content:encoded><![CDATA[<p>Recently someone asked about business in Thailand.  Here is my first post on this challenging topic:</p>
<p>First of all, as background information, I learned the Thai alphabet (script with 44 consonants and 32 vowels) nearly 20 years ago, so I have have a pretty decent foundation for the Thai language compared to most foreigners visting or working in Thailand.   I can read (slowly) and speak better than 99.99+ percent of all foreigners in Thailand.  For this reason, I thought it was &#8221;the right thing to do&#8221; to redirect my career to a &#8220;new challenge&#8221; in the business climate of Thailand as I continue to improve my foreign language skills.   I wanted to help Thailand progress in IT and IT security, so where else would I go but where I have second language skills?</p>
<p>This was no small decision as you can imagine.  Your career and life changes quite dramatically when you give up a long established consulting practice in the US and dive into business in a foreign land, seeking a new challenge.  I can frankly tell you thatit is more difficult to do business in Thailand (as a foreigner) than I expected, for a number of reasons.  Here is my first off-topic post on this topic.</p>
<p>First of all, it is not legal for foreigners to directly own land in Thailand.  Foreigners can &#8221;own&#8221; land using a variety of legal loopholes, proxy owners and shell companies; but all of this is risky and not advised.  Many foreigners lose a lot of money coming to Thailand and attempting to buy land via various &#8220;structures&#8221;.  Some get lucky, but the entire process of foreigners buying and selling land is quite risky and not recommended.</p>
<p>Foreigners can legally own condominiums, under certain conditions, but this &#8220;foreign market&#8221; results in inflated prices for condos in Thailand that are traded in an &#8220;artificial market place&#8221; designed for foreigners.   Condos in Bangkok and major resort areas that are up-to-par with condos in the US can easily cost more than condos in major cities in the US.  Hence, the cost of living in Thailand is not as economical as some might believe when you visit Thailand as a tourist.</p>
<p>Second, business in Thailand can best be described as protectionism with discrimination where the government has placed many barriers to entry to foreigners working and competing in Thailand.     Every foreigner must have a work permit and these work permits are expensive and time consuming to maintain.   If you own a business you must pay high professional service fees for &#8220;auditors&#8221; to perform annual and semiannual audits regardless of how much income you have (including zero).   Firms in Thailand charge thousands of dollars for these &#8221;audits&#8221;.      </p>
<p>Third, if you operate a business in Thailand, you must have a place of business (you cannot legally work from your condo you bought at high prices!), so you are forced, by law, to lease office space.   Foreigners from the US, for example, must be paid a minimum of 50,000 Thai Baht per month, so the government will take 10 percent of that each month as their share of tax withholdings.  Startups with no income simply pay income taxes against their personal savings to comply with the law.  Therefore, to start a company and maintain the business in Thailand, you are required to pay significant startup, monthly, semi-annual and annual fees, permits, tax, leases, visas, etc. </p>
<p>Forth, generating incoming revenue in Thailand can be quite difficult in a climate of both protectionism and discrimination.   In Thailand, it is easy when you are spending money.  This is the &#8221;Land of Smiles&#8221; that tourists see and experience.   However, when you are legally permitted to work in Thailand and trying to generate in-country income, you cannot help but notice the protectionism and discrimination against foreigners working and living here.  Many foreigners working in Thailand just &#8220;give up&#8221; because the barriers to business success are quite high.</p>
<p>Fifth, on top of the challenges of protectionism/discrimination regarding foreigners and foreign investments, which I have only just scratched the surface here, is the overall global business slowdown combined with a climate of political instability which I am sure you have seen in the news.  Thailand has seen 18 coups since 1932.   Currently, <a href="http://www.independent.co.uk/news/world/asia/state-of-emergency-declared-in-thailand-916866.html" target="_blank">Thailand is under a State-of-Emergency </a> which negatively impacts business even more.  Sound challenging? </p>
<p>Most people who live and work in Thailand have the opinion that it is far better to enjoy being a tourist here. Working in Thailand is very difficult for many reasons.   Being a tourist in Thailand is completely different than working here.  When you are a tourist, foreign currently flows from you into Thailand, so life in Thailand as a tourist is fun and friendly, hence the &#8220;Land of Smiles&#8221; you have heard about or experienced.     However, when you are working in Thailand and trying to generate income from Thailand versus bringing in foreign currency, you don&#8217;t see the &#8220;Land of Smiles&#8221; quite the same anymore.</p>
<p>Without getting into too many details in this post, I can simply say that a foreigner doing business in Thailand experiences both protectionism and discrimination.  I came to Thailand hoping to contribute my experience to help the Kingdom.  However, sometimes it feels like foreigners are only welcome if you are working for free, giving seminars for free, and bringing in lots of foreign currency here.</p>
<p>In a future post on business in Thailand I will dive into some details on a number of topics that might be of interest to readers who will never have a chance to come and work here.   </p>

<p>First of all, I learned the Thai alphabet nearly 20 years ago, so I have have a pretty good foundation for the Thai language.   I can read (slowly) and speak better than 99.99+ percent of all foreigners in Thailand; so, I thought it was time to redirect my career to a &#8220;new challenge&#8221; in the business climate of Thailand.   </p>
<p>This was no small decision.  Your career changes dramatically when you give up a successful consulting practice in the US and dive into business in a foreign land for a new challenge.  I can frankly tell you that often the challenge is sometimes overwhelming.    It is quite difficult as a foreigner to do business in Thailand.</p>

<p>Without getting into too many details, I can simply say that a foreigner doing business in Thailand experiences protectionism and, to a certain degree, discrimination, and sometimes I wonder if coming here for a &#8220;business challenge&#8221; was a good idea.    I was seeking a &#8220;new challenge&#8221; and I got more than I bargained for!</p>
<p>In a future post on business in Thailand I will discuss issues regarding how little value is placed in intellectual property in Thailand and how this adversely impacts professional services.    I will also touch on how this lack of regard for intellectual property impacts a consulting practice.   Also, I will touch on some cultural differences in how Thais appear to view teamwork, which is very different than in the US.</p>

<p>It's basically what <a href="http://www.barackobama.com/2008/07/16/remarks_of_senator_barack_obam_95.php">you</a> would <a href="http://www.barackobama.com/2008/07/16/fact_sheet_obamas_new_plan_to.php">expect</a>: Appoint a national cyber security advisor, invest in math and science education, establish standards for critical infrastructure, spend money on enforcement, establish national standards for securing personal data and data-breach disclosure, and work with industry and academia to develop a bunch of needed technologies.</p>

<p>I could comment on the plan, but with security the devil is always in the details -- and, of course, at this point there are few details.  But since he brought up the topic -- McCain supposedly is "<a href="http://www.scmagazineus.com/Cybersecurity-and-the-presidential-campaign/article/112566/">working on the issues</a>" as well -- I have three pieces of policy advice for the next president, whoever he is. They're too detailed for campaign speeches or even position papers, but they're essential for improving information security in our society.  Actually, they apply to national security in general.  And they're things only government can do.</p>

<p>One, use your immense buying power to improve the security of commercial products and services. One property of technological products is that most of the cost is in the development of the product rather than the production. Think software: The first copy costs millions, but the second copy is free.</p></p>

<p>You have to secure your own government networks, military and civilian. You have to buy computers for all your government employees. Consolidate those contracts, and start putting explicit security requirements into the RFPs. You have the buying power to get your vendors to make serious security improvements in the products and services they sell to the government, and then we all benefit because they'll include those improvements in the same products and services they sell to the rest of us. We're all safer if information technology is more secure, even though the bad guys can <a href="http://www.schneier.com/blog/archives/2008/05/dualuse_technol_1.html">use it, too</a>.

<p>Two, <a href="http://www.schneier.com/essay-141.html">legislate results and not methodologies</a>. There are a lot of areas in security where you need to pass laws, where the <a href="http://www.schneier.com/blog/archives/2007/01/information_sec_1.html">security externalities</a> are such that the market fails to provide adequate security. For example, software companies who sell insecure products are exploiting an externality just as much as chemical plants that dump waste into the river. But a bad law is worse than no law. A law requiring companies to secure personal data is good; a law specifying what technologies they should use to do so is not.  <a href="http://www.guardian.co.uk/technology/2008/jul/17/internet.security"> Mandating</a> <a href="http://www.schneier.com/essay-025.html">software</a> <a href="http://www.schneier.com/blog/archives/2007/01/information_sec_1.html">liabilities</a> for software failures is <a href=http://www.schneier.com/essay-116.html">good</a>, detailing how is not. Legislate for the results you want and implement the appropriate penalties; let the market figure out how -- that's what markets are good at.  </p>

<p>Three, broadly invest in research. Basic research is risky; it doesn't always pay off. That's why companies have stopped funding it. Bell Labs is gone because nobody could afford it after the AT&T breakup, but the root cause was a desire for higher efficiency and short-term profitability -- not unreasonable in an unregulated business. Government research can be used to balance that by funding long-term research.  </p>

<p>Spread those research dollars wide. Lately, most research money has been <a href="http://query.nytimes.com/gst/fullpage.html?res=9F04E1DB113FF931A35757C0A9639C8B63">redirected</a> through DARPA to near-term military-related projects; that's not good. Keep the earmark-happy Congress from <a href="http://www.ostp.gov/pdf/1pger_earmark.pdf">dictating</a> how the money is spent. Let the NSF, NIH and other funding agencies decide how to spend the money and don't try to micromanage.  Give the national laboratories lots of freedom, too. Yes, some research will sound silly to a layman. But you can't predict what will be useful for what, and if funding is really peer-reviewed, the average results will be much better. Compared to corporate tax breaks and other subsidies, this is chump change.</p>

<p>If our research capability is to remain vibrant, we need more science and math students with decent elementary and high school preparation. The declining interest is partly from the perception that scientists don't get rich like lawyers and dentists and stockbrokers, but also because science isn't valued in a country full of creationists. One way the president can help is by trusting scientific advisers and not overruling them for political reasons.</p>

<p>Oh, and get rid of those post-9/11 restrictions on student visas that are <a href="http://www7.nationalacademies.org/visas/Statement%20on%20Visa%20Problems.pdf">causing</a> (.pdf) so many top students to do their graduate work in Canada, Europe and Asia instead of in the United States. Those restrictions will <a href="http://www.aau.edu/research/Gast.pdf">hurt us</a> immensely in the long run.</p>

<p>Those are the three big ones; the rest is in the details. And it's the details that matter. There are lots of serious issues that you're going to have to tackle: data privacy, data sharing, data mining, government eavesdropping, government databases, use of Social Security numbers as identifiers, and so on. It's not enough to get the broad policy goals right. You can have good intentions and enact a good law, and have the whole thing completely gutted by two sentences sneaked in during rulemaking by some lobbyist.</p>

<p>Security is both subtle and complex, and -- unfortunately -- it doesn't readily lend itself to normal legislative processes. You're used to finding consensus, but security by consensus rarely works. On the internet, security standards are much worse when they're developed by a consensus body, and much better when someone just does them. This doesn't always work -- a lot of crap security has come from companies that have "just done it" -- but nothing but mediocre standards come from consensus bodies.  The point is that you won't get good security without pissing someone off: The information broker industry, the voting machine industry, the telcos. The normal legislative process makes it hard to get security right, which is why I don't have much optimism about what you can get done.</p>

<p>And if you're going to appoint a cyber security czar, you have to give him actual budgetary authority -- otherwise he won't be able to get anything done, either.</p>

It's basically what <a href="http://www.barackobama.com/2008/07/16/remarks_of_senator_barack_obam_95.php">you</a> would <a href="http://www.barackobama.com/2008/07/16/fact_sheet_obamas_new_plan_to.php">expect</a>: Appoint a national cyber security advisor, invest in math and science education, establish standards for critical infrastructure, spend money on enforcement, establish national standards for securing personal data and data-breach disclosure, and work with industry and academia to develop a bunch of needed technologies.

I could comment on the plan, but with security the devil is always in the details -- and, of course, at this point there are few details.
