In the end, Georgia, with a population of just 4.6 million and a relative latecomer to the Internet, saw little effect beyond inaccessibility to many of its government Web sites, which limited the government's ability to spread its message online and to connect with sympathizers around the world during the fighting with Russia.

<p>In Georgia, media, communications and transportation companies were also attacked, according to security researchers. Shadowserver saw the attack against Georgia spread to computers throughout the government after Russian troops entered the Georgian province of South Ossetia. The National Bank of Georgia's Web site was defaced at one point. Images of 20th-century dictators as well as an image of Georgia's president, Mr. Saakashvili, were placed on the site. "Could this somehow be indirect Russian action? Yes, but considering Russia is past playing nice and uses real bombs, they could have attacked more strategic targets or eliminated the infrastructure kinetically," said Gadi Evron, an Israeli network security expert. "The nature of what's going on isn't clear," he said.</p>

<p>In addition to D.D.O.S. attacks that crippled Georgia's limited Internet infrastructure, researchers said there was evidence of redirection of Internet traffic through Russian telecommunications firms beginning last weekend. The attacks continued on Tuesday, controlled by software programs that were located in hosting centers controlled by a Russian telecommunications firms. A Russian-language Web site, stopgeorgia.ru, also continued to operate and offer software for download used for D.D.O.S. attacks.</blockquote></p>

Cybercriminals attempting to scam other cybercriminals has been happening for years, with old school cases where backdoored malware tools such as crypters and binders are offered for free, or a newly released RAT whose client is in fact infected with a third-party malware. Realizing and definitely not enjoying the fact that the lowered entry barriers into cybercrime are empowering yesterday's script kiddies will malware kits that used to be utilized by a set of people who invested time and money into the process several years ago, this unethical competitive practice is only going to get more common. Backdooring phishing pages is one thing, <a href="http://blogs.zdnet.com/security/?p=1641">backdooring entire web malware exploitation kits, next to the possibility to remotely exploit a competitor's command and control server is entirely another</a> : <br />

"<i>Taking a more strategic approach, a cybercriminal wanting to scam another cybercriminal would backdoor <a href="http://blogs.zdnet.com/security/?p=1598" title="The Neosploit cybercrime group abandons its web malware exploitation kit">a highly expensive web malware exploitation kit</a>, then start distributing it for free, and in fact, there have been numerous cases when such kits have been distributed in such a fraudulent manner. The result is a total outsourcing of the process of coming up with ways to infect hundreds of thousands of users though client side exploits <a href="http://blogs.zdnet.com/security/?p=1122" title="Fast-Fluxing SQL injection attacks executed from the Asprox botnet">embedded or SQL injected at legitimate sites</a>, and basically collecting the final output - the stolen E-banking data and the botnet itself.</i>"<br />

What's to come in the long term? Why just backdoor the phishing page, when you can embedd it with a live exploit URL in an attempt to both, infect the cybercriminal about to use and obtain all of the already stolen virtual assets has has already stolen, and also, <a href="http://ddanchev.blogspot.com/2008/05/skype-phishing-pages-serving-exploits.html">have a third-party maintain a blended attack campaign without even knowing it</a>.<br />

      <title><![CDATA[The Fallacy of Self-Fulfilling CEP Use Case Studies]]></title>

      <content:encoded><![CDATA[<p>I am back at the glaring computer screen after a day in <a href="http://en.wikipedia.org/wiki/Lamphun" target="_blank">Lamphun</a>, Northern Thailand, hanging out will my friends who are preparing for a Bonsai tree competition.  I spent the day eating Thai and Chinese food and relaxing in a lounge chair under imported blue palm trees with the sound of exotic birds making background music to keep me entertained.</p>
<p>Back to CEP and EPTS, there are folks who appear to believe they may define &#8220;CEP&#8221; by the current use cases from self-described CEP vendors. Frankly speaking, I am puzzled by the bottom-up approach.</p>
<p>The bottom-up approach is a bit like saying &#8220;We have a lot of prototype rockets being built, so let&#8217;s define the future of space travel based on the prototypes!&#8221;</p>
<p>It really makes little sense, at least to me, to attempt to define CEP based on what the current generation products (self-described CEP products) are capable of doing.   </p>
<p>From my persective, it would be more beneficial to customers to define the types of complex events (and situations) businesses need to detect in real-time and match the technologies and solution architectures to detect those events, in real-time, with high confidence.</p>
<p>A lot of this &#8220;top down thinking&#8221; has been already done.</p>
<p>IT businesses need to detect operational threats and problems, and be able to pinpoint, with very high accuracy, where the problem is in a complex network, for example.  This problem remains mostly unsolved with a very low signal-to-noise ratio.</p>
<p>Also, most businesses would like to detect fraud and other criminal activity on their network before the activities adversely impacts their business.   This problem remains unsolved for most companies.</p>
<p>Scientific researchers seek models of weather, epidemiology, and so much more; and they need event processing solutions to obtain situational knowledge into current events and predict future ones.  We know how difficult predicting the weather can be!</p>
<p>Folks on the ground need to model urban traffic as events and design better event-driven traffic models and solutions.</p>
<p>The list of important event processing challenges we face go on and on.  </p>
<p>While I see some merit in the bottom-up approach, it is better for users to define what are practical &#8220;complex event&#8221; related problems and then look for the solutions, vs. define the solution and then look for the problem.</p>
<p>From a strategic perspective,  self-fulfilling CEP use case studies are interesting, but they hould not limit the vision, definition, and future of processing complex events; and be careful of use case <a href="http://en.wikipedia.org/wiki/List_of_fallacies" target="_blank">fallacies</a>.</p>

      <content:encoded><![CDATA[<p>Catching up on the blogs, I couldn&#8217;t help but comment on, <a title="Is CEP Mature? Or a Curious Case of Information Asymmetry" href="http://www.coral8.com/blogs/blog-entry/cep-mature-or-curious-case-information-asymmetry">Is CEP Mature? Or a Curious Case of Information Asymmetry</a> by Mark Tsimelzon, President &amp; CTO, Coral8.  Mark says,</p>
<blockquote><p>&#8220;I know for a fact that every <em>major</em> CEP vendor has several dozen paying customers.&#8221;</p></blockquote>
<p>Somehow Mark, I don&#8217;t find a dozen paying customers by the top CEP vendors very impressive.</p>
<p>Then, as to somehow justify the lack of public reference clients, Mark takes the position of a Coral8 customer and says,</p>
<blockquote><p>&#8220;We believe that the use of Coral8 gives us a strategic advantage over our competitors. Why would we want to clue them in?&#8221;</p></blockquote>
<p>Naturally, the same thing could have been said about the first desktop computer, or the first back-office banking system, or the first calculator, or the first telephone, frankly speaking.</p>
<p>Of course, when the technology is mature, then it is &#8220;Hey we have lots of computers!&#8221; &#8220;Hey, look at my fully functional sexy iPhone!&#8221; &#8220;We have the best back office banking systems on the planet by &lt;insert your favorite big vendor here&gt;!&#8221;</p>
<p>Well, all this CEP Solution Secrecy (CEPSS) might just be similar to why the government keeps many IT projects a secret;  the main reason is so we don&#8217;t know how much taxpayer money they are spending!</p>
<p>So, folks, the debate counterpoint that there is some &#8220;Secret Life of CEP&#8221; and that the CEP solutions today are somehow changing the way C-Level executives, and corporate America, thinks is just wishful thinking.</p>
<p>Companies don&#8217;t need to keep their strong technical solutions a secret. Like, Wow! I am using Coral8 and it is so impressive that I have to keep it TOP SECRET.  (Sorry Mark, nothing personal, you simply gave me a big red target and painted &#8220;fire when ready&#8221; on it)</p>
<p>Note:  I happen to like Coral8, and Coral8 Studio, as an event stream processing platform.</p>
<p>Back on point, I consider my laptop and cellphone more indispensable than most of the first generation rule-based stream processing engines out there today, and I am sure most CEOs agree.</p>

In fact, malicious attackers have been building so much confidence in this risk-forwarding process of hosting their campaigns, that they would start actively spamming the links residing within low-profile legitimate sites across the web.<br />
<br />
This campaign serving fake flash players is getting so prevalent these days due to the multiple spamming approaches used, that it's hard not to notice it - and expose it. From a strategic perspective, having a legitimate low-profile site -- of course with the obvious exceptions being on purposely registered for malicious purposes within the participating sites -- hosting your malicious campaign is pretty creative in terms of forwarding the responsibility, and the eventual blocking of a legitimate site to the its owner. As far as the owner's are concerned, it appears that some of them are already seeing the malware page popping-up on the top of their daily traffic stats, and have taken measures to remove it.<br />
<br />
Moreover, <a href="http://blogs.adobe.com/psirt/2008/08/verifying_installers.html">Adobe's Product Security Incident Response Team (PSIRT) issued a warning notice about the attack yesterday</a>, which could come handy if the <a href="http://www.infoworld.com/article/08/08/05/Adobe_warns_of_bogus_Flash_Player_installers_1.html">attackers weren't taking advantage of client-side vulnerabilities</a>, putting the unware end user is a situation where he <a href="http://blogs.stopbadware.org/articles/2008/08/05/same-dogs-new-tricks">wouldn't even receive a download dialog</a> :<br />

<p><strong><em>ScienceLogic:</em></strong> Can you share any of the strategies/advice that you give to companies embarking on their BSM journeys?</p>
<p><strong><em>Doug McClure:</em></strong> Well, first they&#8217;ve got to have a BSM strategy. Nearly all the clients I talk to or hear about wanting to do BSM do not have a BSM strategy. I talk a lot about this on my blog and with clients and it is relevant whether you&#8217;re going to think about &#8220;BSM Lite&#8221; or &#8220;BSM Heavy&#8221; approaches.</p>
<p>Once we have a BSM strategy, we need to establish a BSM roadmap that guides us in how we’ll implement the BSM strategy in a more tactical manner, focusing on short term iterative quick wins and 30-60-90 day projects. <p>As I&#8217;ve alluded to previously, a client first must define and understand what &#8220;BSM Lite&#8221; may mean to them. Don&#8217;t take what the analysts or the vendors pitch for what you should do to achieve BSM or what value you should get from it.</p>
<p>For any type of BSM to be successful, each client must define what BSM means to them and state what they expect to get from BSM. They must make it personal, make it a part of their company culture and elevate it to be as an important initiative as compliance, risk management, SOA, ITIL, or other initiatives may be within the company.</p>
<p>Please don&#8217;t get scared off from this strategy thing. Please don&#8217;t blow this off as something that the secret enterprise architecture council should be doing. If you&#8217;re unable to get an audience in these areas within your company, start within your own sphere of influence.</p>
<p>Your strategy could be as simple as enabling the local operations center to more efficiently classify, triage and resolve problems based on a simple business service or application contextual understanding. Focus on how this changes the game within your environment. Come up with your own metrics and measures to assess the value this has to this organizational use. Trust me, you&#8217;ll need to justify your investment some time in the future.</p>
<p>Another trait of successful BSM implementations is that of the formal monitoring and management tools group has established some sort of database or knowledge repository that enables them to &#8220;manage the business of IT management and monitoring&#8221; if you will. In my opinion, the vendor community has let their clients down significantly in this area. The CMDB may be the correct answer, but most companies just don’t value monitoring enough to demand that this be included in their formal CMDB initiatives.</p>
<p>In my last job, we developed an application that I referred to as the &#8220;Service Management Database&#8221; or &#8220;SMDB&#8221;. Others may call it something else, but in essence, it was the database that captured what was monitored, how it was monitored, who owned it, what business services and applications it supported, the impact an outage or event from it had on the business services or applications, etc.</p>
<p>One key component of this “SMDB” was establishing the relationships of real and synthetic user and transaction monitoring steps to associated servers and applications. This is a significant gap area in many tools and vendor CMDBs.</p>
<p>Clients who have instituted something formal such as this generally have a very good handle on management and monitoring within their environment. Far too many clients do not have adequate monitoring (read visibility) in place to begin their BSM journey.</p>
<p>I&#8217;d strongly recommend a good hard look at how well the client&#8217;s monitoring and management practices are implemented and managed. Simply put, if they don&#8217;t have adequate visibility into how well those business services and applications are performing, you can&#8217;t expect to manage what you can&#8217;t “see” that may be impacting the business, clients, revenue, etc.</p>
<p>Just ask yourself this – can you explicitly state what monitoring is in place for a given business service or application? Can you quantify the impact of a simple event to a business service or application? Can you explain why something is red, yellow, purple or green and what causes it to change from one color to another? If you can’t, your BSM journey will be challenging.</p>
<p>Those with formal CMDB initiatives have their hands full with high risk, long time to value projects to just get a handle with traditional configuration management models. Taking these low level configuration items (CI&#8217;s) and establishing application and service dependencies comes after a lot of work getting through the organizational challenges of getting systems access to populate the CMDB.</p>
<p>I strongly recommend that the formal monitoring and management tools group create an authoritative database that enables them to establish end-to-end visibility into the service and application delivery chain and the impacts it has on the business, customer, etc. This ultimately becomes part of a more realistic federated CMDB within the business.</p>
<p><strong>ScienceLogic:</strong> Can you provide an example of a successful implementation of BSM? Were there specific factors that especially contributed to its success?</p>
<p><strong><em>Doug McClure:</em></strong> I&#8217;ve touched on the highlights of the most successful BSM implementations throughout my previous answers. Clients that have rallied around an organizational change or transformation focusing every team member’s efforts and energy towards ensuring that the business goals and objectives are being met through the delivery of highly available business services and applications.</p>
<p>Far too often the “change” never happens and it’s the “talking heads” that are preaching to the choir about what should be done. Every person on the front line, in the support teams, at the help desk, etc. must understand how they support or impact the business in business terms. Try putting this simple phrase after job titles “Hi, my name is Doug. I’m a Systems Administrator, Supporting the Business”.</p>
<p>That was a mouthful, but simply put, these clients have an impressively instrumented business and IT environment with the right amount of visibility into each area, joined together with an organization that thinks, operates and responds based on their understanding of the business goals and objectives and how these business services and applications enable business success.</p>
<p>The operational model for an organization fully adopting BSM identifies ways to establish a service management mentality across the entire business service and application delivery and support chain. The delivery, operations and support organizations must be incented to manage the services and applications being delivered with this end-to-end context.</p>
<p>A leading, outside the box “service management organization” may include the traditional IT silos but within a matrixed fashion focused on one or more key business services and applications. The &#8220;service management organization&#8221; is then incented to work together, as a team, for the end-to-end delivery and support of these services or applications.</p>
<p>It’s no longer one’s job to just be the systems administrator, database administrator or network engineer, their job is now to support specific business services and applications. They provide the subject matter expertise needed to support the services and applications together, as a team, eliminating the finger pointing or “not my problem” attitudes that exist in the majority of IT organizations today.</p>
<p>Overall, the KISS approach is what will enable BSM of any type (lite, heavy) to be the most successful. If it just feels natural, doesn&#8217;t take any additional effort, clicks or tasks to do then it&#8217;s going to work. BSM should be transparent and not just another buzz word. It&#8217;s not a form that gets filled out or a special process to follow in the run book. It&#8217;s doing the right thing for the business, no matter what the situation, crisis, buzz word or technology initiative of the day is.</p>
<p><strong><em>ScienceLogic:</em></strong> How did you get involved in BSM?</p>
<p><strong><em>Doug McClure:</em></strong> I think the foundations of my service management background and passion were initially established during my service in the US Navy. Today, I relate that experience to what I call BSM for the Military or Mission Services Management (MSM).</p>
<p>We had been taught over and over that extreme attention to the details of the mission at hand (aka &#8220;the business&#8221;) was the number one priority and that all of our technology, services, and applications existed for those Sailors and Marines on the other end (the &#8220;customer&#8221;). I can recall countless instances where mission critical communications services (telephony, orderwires, teletypes, command and control systems, etc.) were impacted in one way or another. It was extremely critical that we understood who was impacted and to what degree so that contingency plans could be activated. We weren’t just talking about lost revenue, poor sales or customer experience; we were talking about human lives and the security of the United States.</p>
<p>It is that military bearing, attention to detail and real world experience that drives me with many of my modern day BSM endeavors. That migration from &#8220;Mission Services Management&#8221; to BSM was honed working for over 10 years working in the Internet Service Provider (ISP) and datacenter, hosting and colocation business.</p>
<p>In those rapid growth businesses during the Internet boom, service differentiation was what &#8220;made you millions&#8221; or paved your way to bankruptcy. The companies I worked for had an extreme passion and focus on ensuring that their services, applications and Internet access products were of the highest quality, highly reliable and just plain better than the competition.</p>
<p>Again, the IT infrastructure, service quality and customer experience relationship was ingrained in all of our heads. It was all hands on deck when Webmail, Internet access, DNS, or the network experienced problems. We were measured in terms of how many customers experienced a busy signal or dropped connection or if you couldn’t log in fast enough to read your email. Companies like Keynote Systems and LionBridge/Veritest/Inverse tested the quality of our networks, services and applications and publicly ranked us against our competition. We thought in terms of customer experience and impact every minute of the day, 24&#215;7.</p>
<p>It was in my last job managing a traditional enterprise management and monitoring development group for a nationwide ISP where I was able to work with emerging technology to help get a handle on the complexities of these rapidly growing IT environments filled with emerging technologies and products. Applying this early technology to complex service problems in our environment proved to me that the technology, coupled with the right emphasis on how the technology was implemented and an emphasis on the people and processes within the organization could bring BSM to life.</p>
<p>Where I felt left out in the cold was with my vendor relationship. While their technology gave me the potential, they didn&#8217;t teach me how to work through the organizational and technological problems to successfully implement the BSM strategy. My very first end-to-end BSM pilot was extremely successful and provided visibility into the IT environment and business service impact that have never been available before.</p>
<p>And here I am today, working at a software vendor for the first time. Welcome to the &#8220;dark side&#8221; as they say. The approach and methodology we followed for BSM has become the basis of the core BSM Methodology that I teach IBMers and our clients around the world today.</p>
<p>My personal mission and drive here at IBM Tivoli is to ensure that BSM is something that the typical monitoring tools administrator can actually implement and that our BSM story is something that any of our clients can be successful with. The sales and marketing slicks must be backed up by something like this whomever you are these days. Clients shouldn&#8217;t put up for “marketecture”, me too and gee whiz buzz words.</p>
<p>BSM takes a partnership and commitment to every client&#8217;s success, and I want to be involved in those BSM efforts in every industry or market worldwide. We need more thought leaders collaborating together in an open and public forum to change legacy attitudes about BSM and do what we can to enable client’s to be as successful as they can be.</p>

      <title><![CDATA[U.S. Arms Dealer Tests Legal Bounds in Middle East Arms Bazaar]]></title>

Former congressman Curt Weldon is helping broker deals between Russian and Ukranian weapons suppliers and the Iraqi and Libyan governments as part of his new job with a private American defense consulting firm, Wired.com has learned. 
</p>

<p>
Weldon, who is currently being investigated by the FBI over alleged corruption during his time in office, visited Libya in March to discuss a possible military deal, according to a letter describing the trip from Weldon to <a href="http://www.ds-pa.com/">Defense Solutions</a> CEO Timothy Ringgold. In May, Weldon, together with Ringgold and another company representative, traveled to Moscow to discuss working with Russia's weapons-export agency on arms sales to the Middle East.
</p>

<p>
Both trips were part of the company's effort to tap into the growing -- and often legally murky -- market for selling weapons from former Eastern Bloc countries to the Middle East and Afghanistan.
</p>

The Russians want to sell weapons to Iraq directly, but "must go slow on Iraq because of political reasons" and want to work with an "intermediary" like Defense Solutions, CEO Ringgold subsequently wrote to colleagues. "They have not spoken with any American company that can offer the quid pro quo that we can or that has the connections in Russia that we have," he boasted.
</p>



<p>
A few years ago, an American company proposing to sell weapons to Libya might have triggered a congressional hearing. So, too, would have a proposal to conduct arms deals with Russia, which the United States has accused of selling high-tech weapons to Syria and Iran. 
</p>

<p>However, U.S. government efforts to rapidly equip countries like Afghanistan and Iraq -- which have largely Soviet-origin weapons -- have created legal ambiguities and loopholes in export controls that didn't exist in years past and given rise to a new class of arms trade middlemen. So, even though both Libya and the Russian arms export agency are on official U.S. blacklists, government officials and analysts involved in weapons sales say the rules have become unclear as the push to equip allies in the global war on terror has blazed new but uncertain legal ground. 
</p>




<p>
Eagerly stepping into that virgin territory is <a href="http://www.ds-pa.com/">Defense Solutions</a>, a Pennsylvania-based company that is carving out a small but lucrative niche in a new international arms bazaar. The firm boasts as its advisors a number of influential Washington insiders, such as retired General Barry McCaffrey, the former White House drug czar.
</p>

<p>
Helping the firm make key connections is Curt Weldon, a former Republican congressman from Pennsylvania at the center of an FBI investigation into alleged conflicts of interest during his time in office.  Weldon, now a key executive at Defense Solutions, is working with the company to set up these weapons deals.
</p>

It's an unusual, if not an entirely unexpected chapter for Weldon, whose time in office included frequent trips to Russia. As an influential member of the House Armed Services Committee, Weldon pushed for multibillion-dollar defense programs, like ballistic missile defense, and earned a reputation as a foreign policy gadfly, boasting of his contacts with officials in nations labeled by the administration as "rogue states" such as Libya and North Korea. Weldon's wild claims about a 9/11 cover-up and his sensationalist book warning of an Iranian terror plot, sometimes earned him official scorn and public ridicule, but it was accusations that he steered contracts to Eastern European businesses linked to his daughter's lobbying firm that drew the government's attention.
</p>

Weldon was voted out of office in 2006 just weeks after the FBI raided his daughter's home, and that of one of her associates.
</p>

<p>
Weldon did not respond to e-mails and phone requests to be interviewed or comment for this article. But in a 2006 interview, before the FBI probe was public, Weldon spoke enthusiastically about setting up a "front company" to work with the Russian arms agency, Rosoboronexport. Weldon hoped this company could sell weapons to the Middle East, and other regions, particularly to countries where the U.S. has strained relations. He claimed the director of Rosoboronexport approached him to work with "an American company that would act as a front for weapons these nations want to buy."
</p>

<p>
Weldon called the proposal an "unbelievable offer."
</p>

<p>
The administration, he acknowledged at the time, did not welcome the idea of an American company selling Russian weapons to potentially unfriendly countries. But two years later, Weldon, now a private citizen and chief strategic officer for Defense Solutions, appears to be working on precisely that sort of deal. And whether illegal or not, Defense Solutions' business represents a new phenomenon in the international arms trade business.
</p>

<p>
In years past arms brokers -- firms or individuals who serve as middlemen to facilitate weapons sales between countries -- were largely the stuff of spy thrillers. Unlike traditional American defense companies, like Lockheed Martin or Boeing, which typically sell weapons directly to NATO countries or other governments regarded as friendly to the United States, brokers are often small outfits run by people with sometimes questionable experience and reputations they will sell to anyone. One of the most infamous arms brokers, a Russian named <a href="http://en.wikipedia.org/wiki/Victor_Bout">Viktor Bout</a>, is charged by the United States, United Nations, Interpol and others of funneling arms to terrorists and rebels around the world. He was recently arrested in Thailand. The United States is requesting his extradition on charges of supplying arms to a terrorist organization.
</p>

But ironically, Iraq has fueled a new market for these professional middlemen; the United States is funneling billions of dollars into modernizing Iraq's army so that the country's government can fend for itself after coalition troops withdraw. And Iraq's largely Soviet-equipped military is a natural market for Eastern European countries brimming with old or out-of-date equipment they would like to unload. The middlemen, in these cases, serve a key role by allowing the U.S. government to do business with an American company, which in turn buys equipment from Eastern Bloc countries in deals worth hundreds of millions of dollars, much of it financed with U.S. taxpayer dollars.
</p>

<p>
One of Defense Solutions' sales -- a deal to sell Hungarian-owed T-72 tanks to Iraq in 2005 -- was typical of these new foreign military sales. But on the more questionable side is the company's plans to work with Rosoboronexport, which is barred from doing business with the U.S. government, and Libya, which is still on the State Department's arms embargo list. 
</p>

<p>
The Eastern European-Middle East arms-brokering business, while in some cases sanctioned by the U.S. government, has run into problems, including outright corruption and quality. Defense contractor Dale Stoffel, the president of Wye Oak Technology, and another American were gunned down in Iraq in December 2004 after Stoffel alleged that the Iraqi Ministry of Defense was involved in a kickback scheme. Like Defense Solutions, the company Stoffel worked for was refurbishing the Iraq's army Eastern Bloc equipment.
</p>

<p>
Another problem is quality. Weapons from the former Soviet Bloc, which the U.S. military euphemistically calls "nonstandard equipment," have been flagged as substandard, acknowledges Brigadier General Charles Luckey, who is in charge of security assistance at <a href="http://www.mnstci.iraq.centcom.mil/">Multi-National Security Transition Command-Iraq</a>. In an interview from Iraq, Brigadier General Luckey said: "One of the frustrating things about buying nonstandard [weapons], is that I'm the guy who has to deal with the fact that some broker I've never heard of allowed weapons to get to Iraq before they were inspected."
</p>

In one high-profile case, Iraqi officials alleged that a corrupt firm sold them $400 million in shoddy helicopters from Poland. More recently, a company led by a 21-year-old and a former masseur was offered a U.S. government contract worth nearly $300 million to sell ammunition to Afghanistan. The ammunition turned out to be outdated and of dubious origin and several people connected with the company have been indicted. A congressional investigation concluded that the company, which was on a State Department watch list, was able to take advantage of regulatory loopholes by using middlemen.
</p>

<p>
For those concerned about illicit arms trade, this new wave of weapons deals is rife with the potential for corruption and abuse, but for companies eager to pursue markets once regarded as dubious, it represents a lucrative business opportunity.  The problem in these cases, according to those familiar with arms sales, is that it's no longer clear what's legal and what's not.
</p>

Rachel Stohl, an expert on international arms trade and a senior analyst at Center for Defense Information, says that in many ways, the rush to equip Iraq has led the United States to throw caution to the wind. She points to a report by the Government Accountability Office last year that found that some 190,000 weapons sold to Iraq have gone missing. "I think the reality is we won't know, until way after the fact, about all of these irregularities with the Iraq weapons provision program," she said. "We were providing them all these assault rifles that have gone missing. Why? They were not following the standard procedures that were in place."
</p>

<p>
But Iraq and Afghanistan aren't the only markets available to arms brokers like Defense Solutions. The gradual normalization of relations with Libya opens another door into a quasi-legal area of sales. 
</p>

<p>
Like Iraq, Libya has a substantial arsenal of Soviet-origin military weapons, offering a potential market for brokers working with Russia and other former Soviet states. But even when there's not an outright ban, sales to the Middle East are often fraught with controversy, particularly to countries like Libya, which was under international sanction for more than a decade. Even as sanctions against it have been lifted, European companies proposing to sell arms to Libya have faced steep criticism, particularly since the country is still ruled by dictator Muammar Gaddafi, who took power in a military coup in 1969. 
</p>

<p>
While the United States lifted Libya's "state sponsor of terrorism" designation in 2006, other restrictions, such as on the sale of arms, remain in place. A State Department spokesperson confirmed that exports of "lethal munitions" to Libya, such as tanks or related equipment, are still banned, although sales of nonlethal equipment are now allowed on a case-by-case basis.

<p>
In late March, Weldon traveled to Libya for a weeklong trip at the invitation of the <a href="http://gdf.org.ly/index.php?lang=ar&Page=101&lang=en">Gaddafi Foundation</a>, a group run by the son of Libya's leader, and the chairman of Libya's foreign affairs committee, according to <a href="http://blog.wired.com/defense/files/libya_trip_report.doc">the report he sent to Defense Solutions</a> (.pdf), a copy of which was obtained by Wired.com. The trip reports states: "Agreement reached for Weldon to quickly return to Libya for meetings with son [of Libyan leader Gaddafi] Morti regarding defense and security cooperation."
</p>

<p>
A document dated April 16, just two weeks after Weldon's trip, outlines Defense Solutions' proposal to Libya to refurbish the country's fleet of armored vehicles, including its T-72 tanks, BMP-1 infantry fighting vehicles, and BTR-60 armored personnel carriers. A copy of the sales proposal, also provided to Wired.com, is on Defense Solutions' letterhead, appears to bear the signature of company CEO Timothy Ringgold, and is addressed to Libya's defense procurement council. "Defense Solutions is committed to delivering a full end-to-end solution to its clients," the proposal states. "Besides refurbishing these vehicles, we are capable of providing a full logistics support package, including a two year supply of spare parts, maintenance and repair services, and operator, maintenance, and repair training."
</p>

<p>
In an interview with Wired.com, Ringgold admitted that he's interested in doing business in Libya and confirms receiving Weldon's trip report from Libya, but denies drafting or signing an arms-sale proposal. "I've never made such a document to Libya," Ringgold insisted, after being read the proposal, and told that his signature is on it.
</p>

<p>
In addition to the Libyan arms-deal document, Wired.com has also reviewed copies of e-mails from Ringgold discussing the Libyan deal.
</p>

<p>
While Ringgold denies proposing an arms sale to Libya, he is open about speaking with Rosoboronexport, which has been on a U.S. government sanctions list since 2006, after the Russian state agency allegedly violated the Iran and Syria Nonproliferation Act. An April e-mail provided to Wired.com describes Ringgold, Weldon and Stephan Minikes, a senior advisor to Defense Solutions and a former ambassador, meeting with Rosoboronexport. The conversations included a number of potential deals, including supplying Mi-17 helicopters to Afghanistan and spare parts for Iraq's infantry fighting vehicles. Ringgold wrote to colleagues following the visit, describing the meetings as a "spectacular success," saying the Russian agency "has the ability to undercut all cost proposals from brokers."
</p>

<p>
Ringgold confirmed those discussions and said that his company has sought to do business with Rosoboronexport. Asked whether Ringgold considers his dealings with Russia to be legal, he argued that U.S. companies could work with Rosoboronexport on a "case-by-case" basis. "The particular purpose of the meeting we had -- and I want to be crystal clear -- was in response to a U.S. government requirement," he said.
</p>

<p>
A number of officials at the State Department and in the Pentagon, when contacted for this article, could not say whether working with Rosoboronexport is legal or not. A Pentagon spokeswoman said she was familiar with the issue, but deferred the question to the State Department. When asked about Rosoboronexport's status on the blacklist, John Herzberg, a State Department spokesman replied: "What's on there is on there."
</p>

<p>
Asked whether, given the ban, there was any way a company could legally work with Rosoboronexport, as Ringgold suggested, Herzberg provided an equivocal answer. "At the stage of the process we're at, I'm unable to give you an answer," he said. "You can try elsewhere in government, and maybe they'll be braver than me."
</p>

<p>
In an interview from Iraq, General Luckey conceded it was a murky area, but said, "My understanding is they are currently on our no-go list." 
</p>

<p>
The confusion over debarred parties has even led the U.S. government into its own legal tangles, according to Jim McAleese, a Washington attorney who specializes in government contracting and foreign military sales. Because the Russian government violated U.S. nonproliferation laws, even NASA had to go to Congress to ensure it could work with Russia on Soyuz flights to the international space station. "What I'm warning you about is, don't be surprised by the confusion," McAleese said. "There are a whole bunch of different statutes that were adopted piecemeal and were never intended to be reconciled."
</p>

<p>
But it's the very ambiguity of the law that troubles those who monitor export control. "It's highly unusual to do anything with the Russians, particularly Rosoboronexport," said Scott Jones, director of Export Control Programs at the <a href="http://www.uga.edu/cits/">Center for International Trade and Security</a> at the University of Georgia. 
</p>

<p>
Legal or not, reputable American companies simply don't want to work with banned entities, Jones said, for fear of risking their reputations and business. "Even if it's not an outright prohibition, most companies don't want to put themselves in a liability situation that has really bad PR … and they stay away from it," Jones said. "But if that's your business, pimping out arms from the U.S. or Russia, that's the way it works, and you push as much as possible."
</p>

<p>
Finding any U.S. defense company working with the Russian government at this point would be "remarkable," Jones added.
</p>

<p>
In the meantime, the future for Weldon is unclear. The FBI investigation continues and Weldon's former chief of staff recently pleaded guilty to a conspiracy charge and is cooperating with the government, notes Melanie Sloan, the executive director of <a href="http://www.citizensforethics.org/">Citizens for Responsibility and Ethics in Washington</a>, which filed a complaint against Weldon in 2004. Sloan speculated that Weldon may be charged with "honest service fraud" for misusing his office for personal gain. "It's an easier standard than bribery," she said. "I wouldn't be surprised [if he's charged] with bribery, but I think it will be honest services fraud."
</p>

<p>
Ringgold insists that he and Weldon are on the right side of the law. "Everything we do is in strict compliance with international and U.S. law and we operate only in the best interests of the U.S. government," he said. "I didn't serve 30 years in the United States Army to throw that away on a whim."
</p>

<p>
Asked if Weldon is still working for the company, Ringgold replied: "Absolutely, proudly so."
